Welcome to our DMCA Policy page. We respect the intellectual property rights of others and expect our users, advertisers, and publishers to do the same. This policy outlines our procedures for addressing alleged copyright infringement under the Digital Millennium Copyright Act ("DMCA") within the context of our programmatic advertising services in games. This includes any copyrighted content, creatives, or other materials served through our platform or displayed within games using our technology.

Filing a DMCA Notice of Alleged Infringement

If you believe that your copyrighted work has been infringed upon and is accessible via our programmatic advertising platform or within games utilizing our services, you may submit a written DMCA notice to our designated Copyright Agent. Please ensure your notice includes the following information, as required by 17 U.S.C. ยง 512(c)(3):

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
  2. A description of the copyrighted work that you claim has been infringed, including the URL or other specific location where the copyrighted work may be found online, or a copy of the copyrighted work itself.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the specific ad creative ID, the name of the game and publisher where the ad appeared, the approximate date/time it was seen, or other relevant identifying details).
  4. Information reasonably sufficient to permit us to contact you, such as your name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

DMCA Counter-Notification

If you believe that material you posted or served through our platform was removed or access to it was disabled by mistake or misidentification, you have the right to file a counter-notification with our Copyright Agent. Your counter-notification must be a written communication and substantially include the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (e.g., the specific ad creative ID, the name of the game and publisher where the ad appeared).
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which we may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
